Liability Waiver

NOTICE: THIS IS A LEGAL DOCUMENT WAIVING ANY LIABILITY AGAINST FIFTY WEST BREWING CO. I understand that participation in sports activities involves certain risks, including but not limited to, death, serious neck and spinal injuries resulting in complete or partial paralysis, brain damage, and serious injury to virtually all bones, joints, muscles, and internal organs, and that equipment provided for my protection may be inadequate to prevent serious injury. In addition, I understand that participation in any sport, league, training group, or activity involves activities incidental thereto, including but not limited to, travel to and from the site of activity, participation at sites that may be remote from available medical assistance, and the possible reckless conduct of other participants. I am voluntarily participating in this activity with knowledge of the danger involved and hereby agree to accept any and all risks of property damage, personal injury, or death. I further agree to indemnify and hold harmless Fifty West Brewing Company, LLC, DeSlatt, LLC, Slatts Development, LLC, Perimeter Technologies Inc., and others listed for any and all claims arising as a result of my participation in sports, leagues, training groups, or activities or any activities incidental thereto, wherever, whenever, or however the same may occur. Dogs: Fifty West Brewing Company and others listed above requires the owner or individual in possession of a dog which is on the property of Fifty West Brewing Company as an invitee/patron shall keep at all times the dog in the following manners: • Firmly secured by means of a collar and chain or other device (leash), so that it cannot stray beyond the premises on which it is secured. • Under the reasonable control of some person, preferably the owner, at all times. • Confined exclusively to the patio and taproom areas. • Off the boardwalk area, volleyball courts, ice rink, balcony, parking lot (unless returning to a car), and inside the brewing production facility at all times. Photo/Video Release: I grant Fifty West Brewing Company, LLC and its affiliates the irrevocable right to use, reproduce, modify, distribute, and publicly display any photographs, video recordings, or other likenesses of me taken while on Fifty West Brewing Company property, including during leagues, events, and activities, for any lawful purpose, including but not limited to advertising, marketing, social media, promotional materials, and website content, without further compensation or prior approval. Communications Consent: By providing my phone number and/or email address, I consent to receive communications from Fifty West Brewing Company, LLC and its affiliates, including but not limited to league updates, schedule changes, score notifications, and event information.
